Together with the Netgate Terms, the Software Terms, and other terms and conditions posted on the support pages on Netgate.com, these Hardware Warranty Terms govern your Warranty coverage for Netgate branded products as described below.

Product Warranty Details
The sole warranty for all manufacturers products sold by Netgate shall be the Limited Warranty as set forth in the documentation that accompanies each product. If no documentation is available, you may check our website or the manufacturer’s website for further details.
The following terms and conditions govern your warranty on Netgate branded products. They supersede all other terms, unless otherwise agreed in writing by Netgate.
1. Warranty Start Date
“Start Date” as used in this policy means the date the product is shipped from the manufacturing facilities of Netgate.
2. Standard Limited Warranty
2.1.1. Goods not manufactured by Netgate
Goods not manufactured by Netgate are the products of reputable manufacturers sold under their respective brand or trade names. We make no express or implied warranty as to such goods. Non Netgate-branded or third-party products are sold “AS IS” by Netgate, but may be accompanied by their manufacturers’ standard warranties. Your remedies for defects of goods are subject to any limitations contained in their manufacturers terms and conditions to us and the provisions of the manufacturer’s warranty. Most warranties are available on the respective manufacturers website, or are available from us upon request. We try to include accurate and relevant manufacturers warranty information on each product page, however the manufacturers warranty will always apply.
2.1.2. Supermicro Warranty
For Supermicro products sold by Netgate, please refer to the Supermicro Limited Warranty on their website at https://www.supermicro.com/support/Warranty/. The Supermicro Limited Warranty may provide additional benefits beyond the standard Netgate warranty.
2.2. Netgate-Branded Products
Netgate-branded products are subject to the Standard Limited Warranty as specified in the product documentation and below.
For a period of twelve (12) months from the Start Date, Netgate warrants that the Netgate-branded product hardware will be free from defects in materials and workmanship under normal use. End User’s sole and exclusive remedy and the entire liability of Netgate and its suppliers under this limited warranty will be, at Netgate’s option, repair or replacement of such product hardware within thirty (30) working days of its receipt of the failed hardware, if in advance of its receipt, such hardware received a Technical Support RMA number from Netgate. Further, the product hardware must be shipped, shipment pre-paid, to Netgate, and the RMA number must be clearly indicated on the shipping box and papers. Where applicable, for shipments to locations outside the US, Customer or Customer’s assigned agent will act as Importer of Record for shipments of repaired/replacement units and will be responsible for payment of any import duties, taxes and fees. 2.2.2. Software (embedded in Netgate hardware)
For a period of ninety (90) days from the Start Date, Netgate warrants (a) that the media on which the software is delivered will be free of defects in material and workmanship, and (b) the software will operate substantially as set forth in the applicable Netgate specifications when used in accordance with the terms of the Netgate software license. End User’s exclusive remedy and the entire liability of Netgate and its suppliers under this limited warranty will be replacement of the software media. Except for the foregoing, the software is provided AS IS. This limited warranty extends only to the End User as the original licensee. See other Warranty Limitations and Restrictions below.
2.2.3. Software (Stand Alone Software Products)
Stand Alone Software is provided AS IS. Netgate Support Offerings can be found on our Support Page
3. Shipping Costs
If Netgate services your warranty request, you are responsible for shipping costs both ways.
4. Optical Transceivers
In order to ensure proper operation of Netgate products, it is required that all Netgate systems utilize only Netgate recommended optical transceiver components. Netgate reserves the right to void warranty and service support offerings if optical transceiver components other than those recommended by Netgate are used in the operation of Netgate products.
5. Warranty Limitations and Restrictions
Netgate warranties as set forth herein (“Warranty”) are contingent on proper use of the Netgate branded hardware and software (“Products”) and do not apply if (a) the Products have been modified without the written approval of Netgate, (b) the Products’ serial number label is removed, (c) the Product has been damaged or subjected to abnormal physical or electrical stress, abnormal environmental conditions, misuse, negligence, or accident, or (d) the Product is licensed for beta, evaluation, testing or demonstration purposes. The terms of the Warranty are limited to the remedies as set forth in this Warranty.
EXCEPT FOR THE WARRANTIES EXPRESSLY STATED IN THE HARDWARE TERMS, SOFTWARE TERMS, SUPPORT TERMS OR SERVICES TERMS, THE PRODUCTS, SERVICES, DELIVERABLES, AND THIRD PARTY PRODUCTS ARE PROVIDED AS IS AND NEITHER NETGATE NOR ITS SUPPLIERS OR LICENSORS MAKES ANY OTHER WARRANTY, EXPRESS OR IMPLIED. NETGATE DISCLAIMS ANY IMPLIED WARRANTIES, SUCH AS ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES THAT MAY ARISE FROM A COURSE OF DEALING. SPECIFICALLY, BUT WITHOUT LIMITATION, NEITHER NETGATE NOR ITS SUPPLIERS OR LICENSORS WARRANT THAT THE PRODUCTS, SUPPORT PLANS, SERVICES, DELIVERABLES AND THIRD PARTY PRODUCTS WILL MEET YOUR REQUIREMENTS, WILL OPERATE IN THE COMBINATION WITH OTHER TECHNOLOGIES OR PRODUCTS YOU SELECT, OR THAT THE OPERATION OR USE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. IF ANY WARRANTY CANNOT BE EXCLUDED BY OPERATION OF LAW, THEN SUCH WARRANTY SHALL BE VALID AND EFFECTIVE ONLY FOR A PERIOD OF THIRTY (30) DAYS FROM THE ORDER EFFECTIVE DATE.
NETGATE MAKES NO OTHER EXPRESS OR IMPLIED WARRANTY WITH RESPECT TO THE SOFTWARE, HARDWARE, PRODUCTS, DOCUMENTATION OR NETGATE SUPPORT, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. Netgate DOES NOT WARRANT THAT ANY PRODUCTS WILL BE ERROR-FREE, OR THAT ANY DEFECTS THAT MAY EXIST IN ITS PRODUCTS CAN BE CORRECTED. IN NO EVENT SHALL NETGATE BE LIABLE FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS, LOST PROFITS OR ANY OTHER SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST DATA), HOWEVER CAUSED WHETHER OR NOT NETGATE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR EXCLUSION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THAT LIMITATION OR EXCLUSION MAY NOT APPLY. THIS WARRANTY IS PROVIDED IN LIEU OF ALL OTHER RIGHTS, CONDITIONS AND WARRANTIES.
